Acceptance of Terms

By accessing or using Align Prosthetics' services, website, or facilities, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

These terms apply to all clients, visitors, and others who access or use our services.

Services Description

Align Prosthetics provides professional prosthetic and orthotic services, including but not limited to:

  • Initial consultations and assessments
  • Design and fabrication of custom prosthetic devices
  • Design and fabrication of custom orthotic devices
  • Device fittings and adjustments
  • Follow-up care and maintenance services
  • Advice and education on device use and care

All services are provided by qualified prosthetists and orthotists in accordance with Australian healthcare standards and industry best practices.

Appointments and Cancellations

Scheduling: Appointments can be scheduled by phone, email, or through our online booking system. We will confirm all appointments via your preferred contact method.

Cancellation Policy: We require at least 24 hours' notice for appointment cancellations or rescheduling. This allows us to offer the time to other clients who may need our services.

Late Cancellations: Cancellations made with less than 24 hours' notice, or missed appointments without prior notification, may incur a cancellation fee equivalent to 50% of the scheduled appointment cost.

Emergency Situations: We understand that genuine emergencies occur. Please contact us as soon as possible if an emergency prevents you from attending your appointment.

Payment Terms

Payment Due: Payment is due at the time of service unless alternative arrangements have been made in advance.

Accepted Payment Methods: We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • EFTPOS
  • Direct bank transfer
  • NDIS funding (for eligible clients)
  • Private health insurance claims
  • Medicare (where applicable)
  • DVA (Department of Veterans' Affairs)
  • WorkCover

NDIS Clients: For clients funded through the National Disability Insurance Scheme, services must be within your approved plan and budget. You are responsible for ensuring adequate funds are available in your plan.

Insurance Claims: While we can provide all necessary documentation for insurance claims, it remains your responsibility to submit claims and follow up with your insurer. Payment is required regardless of insurance approval.

Outstanding Accounts: Accounts outstanding beyond 30 days may be referred to a collection agency. You will be responsible for all reasonable costs associated with debt recovery.

Client Responsibilities

As a client of Align Prosthetics, you agree to:

  • Provide accurate and complete health information, including medical history, current conditions, medications, and allergies
  • Inform us promptly of any changes to your health status that may affect your treatment
  • Follow prescribed care instructions and treatment plans
  • Attend scheduled appointments or provide appropriate notice of cancellation
  • Maintain your prosthetic or orthotic device according to provided guidelines
  • Report any issues, discomfort, or concerns with your device promptly
  • Ensure payment for services as outlined in these terms
  • Treat our staff and facilities with respect

Failure to fulfil these responsibilities may affect the quality of care we can provide and may result in termination of services.

Device Warranty and Maintenance

Workmanship Warranty: We warrant that all custom-fabricated devices are free from defects in workmanship for a period of 12 months from the date of delivery.

Component Warranties: Manufactured components are covered by the manufacturer's warranty. We will assist with warranty claims where applicable.

Warranty Exclusions: Warranties do not cover:

  • Normal wear and tear
  • Damage resulting from misuse, abuse, or failure to follow care instructions
  • Modifications made by unauthorised parties
  • Changes in limb volume or shape requiring device modification

Maintenance: Regular maintenance is essential for device longevity and safety. We recommend scheduled check-ups as advised by your prosthetist or orthotist.

Intellectual Property

All content on the Align Prosthetics website, including text, graphics, logos, images, and software, is the property of Align Prosthetics and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without express written permission.

Custom device designs and fabrication techniques developed by Align Prosthetics remain our intellectual property, though you retain ownership of the physical device provided to you.

Limitation of Liability

While we take every reasonable precaution to provide safe and effective services, prosthetic and orthotic care involves inherent risks. By using our services, you acknowledge and accept these risks.

To the fullest extent permitted by law, Align Prosthetics shall not be liable for:

  • Any injuries or complications arising from failure to follow prescribed care instructions
  • Issues resulting from incomplete or inaccurate health information provided by the client
  • Changes in health status between appointments that affect device fit or function
  • Indirect, incidental, or consequential damages arising from use of our services

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Our total liability for any claims relating to our services is limited to the amount paid by you for the specific service giving rise to the claim.

Privacy and Confidentiality

We are committed to protecting your privacy and maintaining the confidentiality of your personal and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Professional Standards and Complaints

Align Prosthetics is committed to maintaining the highest professional standards in all aspects of our service delivery.

Complaints Process: If you have a concern or complaint about our services, we encourage you to contact us directly so we can address the issue promptly. All complaints will be:

  • Treated seriously and investigated thoroughly
  • Handled confidentially
  • Resolved as promptly as possible
  • Used to improve our services where appropriate

External Review: If you are not satisfied with our response to your complaint, you may contact the Australian Orthotics Prosthetics Association (AOPA) or the relevant healthcare complaints authority in Queensland.

Termination of Services

We reserve the right to terminate or refuse services in the following circumstances:

  • Repeated failure to attend scheduled appointments without notice
  • Outstanding payment obligations that remain unresolved
  • Abusive, threatening, or disrespectful behaviour towards staff
  • Failure to provide necessary health information or follow care instructions
  • Where we reasonably believe that continuing services would be unsafe or inappropriate

In such cases, we will provide reasonable notice and, where appropriate, assist with transition to alternative service providers.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website, with the "Last updated" date revised accordingly.

Material changes to these terms will be communicated to existing clients via email or other appropriate means.

Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Queensland.
